US Citizen Tried in UAE Denied Public Court Hearing

WASHINGTON, DC (MASNET) July 21, 2009 – MAS Freedom (MASF) as the civic and human rights advocacy entity and sister organization of the Muslim American Society (MAS), has lodged a formal complaint with the United Arab Emirates Ambassador to the United States, Yousef Al Otaiba, in response to the abrupt closing to the public of the July 20 trial of American citizen, Naji Hamdan.

Hamdan, 43, a successful Muslim American international businessman and former southern California resident for two decades, has been detained for the past 11 months by U.A.E. authorities at the behest of the U.S. government. He was subsequently charged with promoting terrorism, allegations that evidence suggests are based on false statements obtained through torture.

MAS Freedom has also sent a letter to Secretary of State Hillary Clinton, asking her to lodge a formal inquiry into Hamdan’s detention, allegations of torture, and the now closed legal proceedings.

“As MAS Freedom has previously reported, the Hamdan case has been tainted by allegations of proxy detention and torture, now it has been removed from the public eye altogether. We are requesting an emergency meeting with the U.S. State Department and the UAE Embassy here in Washington. MAS Freedom has strong concern for the potential life or death plight of this U.S. citizen,” stated MAS Freedom Executive Director, Mahdi Bray.

Bray added, “The American Civil Liberties Union, Amnesty International, and other human rights organizations have already articulated the grave human rights concerns the Hamdan case presents, all of which are compacted with the trial proceedings being closed to the public. Allegations of torture and the lack of transparency surrounding this case should certainly prompt serious questions and action from our government vis-à-vis the UAE.”

“Mr. Hamdan is an American citizen yet there has been no serious outcry from our government in reference to his detention and trial in a country where a member of the royal family is shown physically abusing an individual on a video provided by ABC News. Mr. Hamdan should be afforded all of the protection from abuse and legalistic shenanigans that are currently taking place in the UAE. When other Americans, such as the journalist in Iran and those in North Korea were detained, the world witnessed immediate response and action on the part of the U.S. State Department and members of Congress. Why hasn’t this American Muslim been afforded the same support? This double standard is not acceptable and the American people deserve a real answer from our government concerning Naji Hamdan,” Bray concluded.

Giving rise to the concerns of human rights activists across the nation is the fact Hamdan faces the possibility of a life or death sentence if found guilty, and U.A.E. Federal Supreme Court decisions are not reversible.
