MAS Freedom and Muslim Legal Fund of America to Collaborate on Political Asylum Case of Foad Farahi

WASHINGTON, DC (MASNET) Feb. 09, 2010 –  MAS Freedom and the Muslim Legal Fund of America have joined forces on the political asylum case of Foad Farahi.  Some legal experts have described this case as one of the more intriguing political asylum cases of our times.

Foad Farahi is a Muslim immigrant and a respected Islamic leader and community member in the Miami, Florida area. He is a citizen of Iran by passport designation, although he spent most of his life in Kuwait before coming to the United States. His original petition for political asylum was revoked by the United States Customs and Immigration Service (USCIS).

After many judicial obstacles and maneuvers, he appealed that decision to the Administrative Appeals Office which then had jurisdiction over the case. In addition to these filings, Foad had to sue in federal court to re-open his case because it was originally contested by Immigration Customs and Enforcement. The Board of Immigration Appeals denied his petition, which effectively left him without a country to go to.

If Foad were to be deported from the United States, the only country available to receive him would be Iran, a country in which he has never lived. Due to this fact, his attorneys filed a motion to reexamine the court decision to deny his asylum application. This motion to re-open the application stated the new facts that support Foad’s humanitarian right to remain in the U.S.A.

Most recently, the United States Justice Department has agreed not to contest his most recent application for asylum.
